What is GDPR?

The GDPR abbreviation stands for the General Data Protection Regulation 2016/679 of the European Parliament and Council dated 06 April 2016. GDPR substitutes the Data Protection Directive 95/46/EC. It was designed to coordinate data privacy laws across the European countries, Canada, and other countries to protect individuals with regard to personal data processing and its free movement. Where appropriate, the terms used in this GDPR Policy shall have the meanings ascribed to them in the GDPR.

GDPR creates a unified legal framework for handling personal data across the above mentioned countries, where it is directly enforceable and applicable (i.e., requires no further legislation).

GDPR Data Protection Statement 

Cyber Bricks as a company is aware of its responsibilities under GDPR. We have prepared this statement about the actions that have been taken towards compliance.

We would like to assure you that your data remains safe and secure even after it leaves your native country. Hopefully this document will help you to better navigate the international data protection requirements. For any questions regarding the above, you are welcome to contact us at the email indicated at the end of this document. 

If for any reason either party (the “Receiving Party”), its contractors, agents, or employees are allowed to access the personal data held by the other party or are supplied with personal data by the other party, the Receiving Party, its, contractors, agents or employees shall: (i) use or store such personal data only in the manner and for the purposes agreed with the other party and shall not modify, change, or amend the contents thereof unless expressly authorized in writing by the other party and shall take all the necessary steps to safeguard such personal information; (ii) comply in all respects with the GDPR and the local applicable law and shall not do or allow anything to be done which could jeopardize the terms of the other party’s notification under the GDPR or local applicable law; (iii) indemnify the other party against all damages, costs, claims, and liabilities which it may incur due to any default under this clause or any breach of the GDPR or local applicable law attributable to or caused, directly or indirectly, by the Receiving Party, its employees, contractors, or agents, including the failure to prevent disclosure thereof in contravention of the GDPR or local applicable law.

How We Use the Information

  1. Information about your use of our Platform. We use information related to your presence on our Platform to build more useful Services. We carry out statistical analyses of the collective behavior and characteristics of our visitors. We also measure their demographics and interests in certain areas of our Platform. In the future, we may use this information to ensure the security of our services.

  2. Personally Identifiable Information (PII) users provide us directly or via third parties. Except as explicitly stated in this GDPR Policy or specifically agreed to by you, Cyber Bricks will not disclose any of your PII. In addition to the provisions hereof, we may disclose or otherwise use your PII as described below:

  • Providing access to the Platform and our services. We use PII provided by our users to allow them to access and use the Platform and provide any requested information, products, or services.

  • Security and technical support. We may use PII to provide technical support to you and ensure the security of our Platform and services.

  • Updates. We use PII collected when you sign-up for our mailing list about the Platform or Content Offerings. We may archive this information and use it for future communications, in situations where we are legally entitled to do so.

  • Our Web Pages. You should not post any PII or other information of sensitive nature relating to you or another person within our Platform. If you choose to post PII, it may be collected and retained. We may publish this information through our Platform’s extensions that use third-party services (e.g., mobile applications). We reserve the right to reuse user’s publications that contain PII in the future versions of the content offerings. We may also use them to enhance our services. We may archive this information or use it for future communications, provide it to the content providers, business partners, or instructor(s) associated with the courses you have purchased. We also reserve the right to use or publish users’ posts on the Platform without their PII.

  • Participation in Content Offerings. We use the PII that we collect from you when you participate in a content offering through the Platform for processing purposes. The collected data includes without limitation tracking your attendance, progress, and completion of the content offerings. We may also share your PII and performance in a given content offering with the instructor who taught it, with teaching assistants, or other individuals designated by the instructor to assist with the creation or operation of the content offering, and with the affiliated content provider. We may also use the information generated during your taking a content offering or using our services for predictive analysis of your performance. We may archive this data and use it for future communications with our users, where we are legally entitled to do so.

  • Identity Verification. We may use the PII that we collect to verify your identity or authenticate that submissions made on our Platform were yours. This service may be fulfilled through a third-party identity verification vendor. We will delete your photo identification document upon the successful verification of your profile.

  • Communications with our users. When you email us or otherwise contact us, we may use the information provided by you to answer your communication or as set forth herein. We may archive this data and/or use it for future communications where we are legally entitled to do so. We may also track the way that you interact with our emails (when you open them or click on a link inside them). We use this information to optimize and tailor our communications with you.

  • Communications with Our Business Partners. We may share your PII with content providers and other business partners. Thus, the content providers and other business partners may share information about their products and services that may interest you where they are legally entitled to do so.

  • Research. We may share general educational data (quiz or assignment submissions, grades, and discussions), information about your activity on our Platform, and demographic data from surveys so that our content providers and other business partners could use the data to research online education.

  • Disclosure to Maintenance Contractors. We use various vendors, service providers, and contractors (collectively referred to as “Vendors”) to assist us in providing our services. Our Vendors may have limited access to your PII in the course of providing their services to us, so that we can provide our services to you. These Vendors may include contractors and suppliers that provide us with technology, services, and content related to the operation and maintenance of the Platform and our content offerings. Access to your PII by these Vendors is limited to the information necessary for the Vendor to perform its limited function for us.

  • Government Authorities. Cyber Bricks may share your PII with various government authorities in response to court orders and other legal processes; to establish or exercise our legal rights; to protect our property; to defend against legal claims; as otherwise required by law. We reserve the right to raise or waive any legal objection or right. We also may share your PII when we consider it is appropriate to investigate, prevent, or take action regarding any illegal or suspected illegal activities; to protect and defend the rights, property, or safety of Cyber Bricks, its Platform, users, or customers; and in connection with our Terms of Use and other agreements.

  • Disclosure to Acquirers. Cyber Bricks may disclose or transfer your PII to an acquirer, assignee, or other legal successor in connection with a sale, merger, or reorganization of the equity, business, or assets of Cyber Bricks to which your PII relates.

  • e-Readers. If we receive any PII related to the extent to which you use e-Readers or other devices to access Cyber Bricks materials, we may retain it and use it for research, business, or other purposes.

Retention of Personally Identifiable Information

We keep your PII for no longer than reasonably necessary for the purposes for which the PII is collected and processed. The length of time we retain PII depends on the purposes for which we collect it or as required to comply with applicable laws and to exercise or defend our legal rights.

For your convenience we may provide links to websites operated by organizations other than Cyber Bricks (“Third Party Websites”) that we believe may be interesting to you. We do not disclose your PII to these Third Party Websites unless we have a lawful basis to do so. We do not endorse and are not liable for the privacy practices of these Third Party Websites. If you click on a link to one of these Third Party Websites, we insistently recommend you to review the privacy policy posted on their website to understand how they collect and use your PII.

Confidentiality & Security of PII

We will use industry-standard technical, physical, and administrative security measures to keep your PII confidential and secure. We will not share it with third parties, except as otherwise provided herein, or unless such a disclosure becomes necessary in special cases (physical threat to you or others, as permitted by applicable law). The Internet is not a 100% secure environment. Thus, we cannot guarantee the security of your PII, and there is some risk that an unauthorized third party may find ways to circumvent our security systems or that transmission of your PII over the Internet will be intercepted. It is your responsibility to ensure the security of your login information. Please note that email communications are typically not encrypted and not considered secure.

Updating or Deleting Your PII

You have certain rights in relation to your Personally Identifiable Information. You can access it and confirm that it remains correct and updated, choose whether you wish to receive updates from us or our partners, and request that we delete or provide you with a copy of your PII. The ability to delete an  account may be disabled for some users, particularly those who are enrolled in for-credit offerings.

If you would like to know more about your rights or would like to exercise any of them, please contact us via [email protected]. In particular, you may request us to:

  • provide access to any PII we hold about you;

  • prevent the processing of your PII for direct-marketing purposes;

  • update any outdated or incorrect PII;

  • delete any PII which we hold about you;

  • restrict the way we process your PII;

  • provide your PII to a third-party vendor; or

  • provide you with a copy of any PII which we hold about you.

We try to answer each request as soon as possible and provide our response within the time stated by the applicable law. However, when deleting your PII there may be residual information that will remain within our files, access logs, and other records, which may or may not contain your PII. Please also note that certain information be exempt from such requests in certain circumstances, for instance when we need to retain your Personally Identifiable Information to comply with a legal obligation. When you email us with a request, we may ask you to provide us with your identity information.
