These Terms of Use outline the rules and regulations for your presence on Cyber Bricks’ website, located at https:/cyber-bricks.com. By accessing this website, you represent and warrant your acceptance of these Terms of Service. Please, review this page and discontinue using Cyber Bricks if you do not agree with any of the statements here.

Terms and Definitions

1. “Client," “You,” and “Your” means any user, i.e., the person logged on this website and compliant to our Terms of Service. 

2. “The Company,” “CYBER BRICKS”, “CYBER BRICKS LLC”, “We,” “Our,” “Us,” and “Ourselves,” refers to Cyber Bricks.
   

All the terms refer to the offer, consideration, and acceptance of payment required to undertake the process of our assistance to the user in the most appropriate manner. For instance, for the express purpose of meeting the user’s needs related to the provision of our stated services, in accordance with and subject to the prevailing law of Poland, any use of the above-mentioned terminology or other words can be done in the singular, plural, or capitalized form. And/or he/she or they, are taken as interchangeable and thus as referring to the same.

Unless otherwise stated, Cyber Bricks and/or its licensors own the intellectual property rights for all the content on cyber-bricks.com, as well as all the materials and information sent through other communication means (email, live chat, etc.). With us, all your intellectual property rights are reserved. You may all the above-mentioned materials from Cyber Bricks for your personal use, subject to the restrictions set in these Terms of Use.

You shall not:

• Republish material from Cyber Bricks,

• Sell, rent, or sub-license material from Cyber Bricks,

• Reproduce, duplicate or copy material from Cyber Bricks,

• Redistribute content from Cyber Bricks.

These Terms of Service shall come into force upon your first visit to cyber-bricks.com, regardless of whether you have read this document or not. Please note that we shall bear no responsibility for any unlawful usage of our services and copyright infringements by third parties. The guarantees mentioned herein shall apply only to the area of responsibility of Cyber Bricks.

You will have access to our Services only if you have concluded a binding contract with Cyber Bricks, and only in compliance with these Terms of Use and all the applicable laws. Upon the creation of your Cyber Bricks account, and subsequently using certain features, you should provide us with valid and complete information. You hereby agree to update your personal information to keep it valid and complete.

3. Paid Services

Cyber Bricks offers paid services (content offerings) for a fee indicated on the Prices page of this website. Unless provided to the contrary, all prices are quoted in the U.S. Dollars. Each user shall be responsible for paying the fees charged by Cyber Bricks, including the applicable taxes, in a timely manner and in full extent. The available payment methods are listed in the Order Form of this website. If a user’s payment method fails or their account is no longer valid or existing, we may collect the payment through collection mechanisms.

We reserve the right to change the prices of lessons, courses, and themes at our sole discretion at any time. The prices may vary based on your location and some other factors. Any changes or updates will become effective immediately upon their posting on the relevant page of this website.

4. Academic Credit

Cyber Bricks does not provide any academic credit for the completion of its Lessons, Themes, or Courses. Unless provided otherwise by a credit-granting or educational institution, completion or participation in Cyber Bricks Courses does not confer any academic credit to its users. Even if one institution awards the credit, there is no guarantee that other institutions will accept it. You hereby agree not to accept credit for participating in a Cyber Bricks Course unless you have been granted a course certificate or other similar document for your completion of the Cyber Bricks Course. Our instructors, content providers, and Cyber Bricks as a whole have no obligation to have its Courses recognized by any accreditation organization or educational institution.

5. Hyperlinking to Our Content

The following organizations may link to our website without a prior written approval:

• Government agencies;

• Search engines;

• News organizations;

• Online directory distributors (in the same manner as they hyperlink to the websites of other listed businesses).

We will approve link requests from these organizations if we decide that:

1. The link would not make us look unfavorable to ourselves or to our accredited businesses; 

2. Such an organization does not have any negative records with us; 

3. The benefit to us from the visibility of the hyperlink compensates the absence of Cyber Bricks; and 

4. The link is in the context of general resource information.

These organizations may link to our home page as long as the link: (a) is not deceptive; (b) does not falsely imply sponsorship or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s website.

If you are one of the organizations listed above and are interested in linking to our website, please inform us by sending an email to [email protected]. Please indicate your name, organization, contact information, URL of your website, list of any URLs from which you intend to link to cyber-bricks.com, and a list of the URLs on our website to which you would like to link. It may take us 3 to 4 weeks to prepare a response.

No use of Cyber Bricks logo or other artwork shall be allowed for linking if there is no trademark license agreement.

6. Removal of Links from Our Website

If you find any link on our website that is offensive for any reason, you are free to contact us at [email protected] and inform us at any moment. We will consider all the requests to remove links.

7. iFrames

You are not allowed to create frames around our web pages that alter in any way the visual presentation of our website without prior written approval.

9. Reservation of Rights

We reserve the right to ask you to remove all the links or any particular link to our website. You approve to immediately remove all the links to our website upon request. We also reserve the right to change these Terms of Use and the linking policy at any time. By continuously linking to our website, you agree to be bound by and follow these linking Terms of Use.

10. Billing, Termination, Cancellation, and Refund on Monthly & Yearly Subscriptions

Cyber Bricks offers monthly and yearly subscriptions, which entitle the original purchaser to access Cyber Bricks services for the precise period of 1 month/1 year upon the date of purchase.

The purchaser agrees to pay all fees in effect when incurred. You will be billed for your subscription in advance at the time of purchase, and the subscription will automatically renew until explicitly canceled. If you cancel our services, your cancellation shall become effective on your next billing cycle. It means we will not be able to refund you for early contract cancellation. All Cyber Bricks accounts begin with an obligation-free trial, which will allow you to evaluate the service. This includes free access to url of user account. Note that the subscription plan starts immediately after the payment takes place, which involves confirming user settings and completing the payment process on the payment page. 

We recommend you to sign up for a monthly payment schedule if you are unsure of how long you will be using the service. If you have questions about our charges, please contact us immediately. We shall immediately credit your account or credit card account for the appropriate amount for any charges that were made in error. 

Cyber Bricks has a zero-tolerance policy for chargebacks. Any customer who disputes a credit card payment that is found to be valid will be permanently blacklisted and barred from the use of the service. Any past due fees and costs will be sent to collections. If our collection efforts fail, unpaid debts will be reported to all available credit reporting agencies.

If Cyber Bricks terminates your account because of a violation of our Terms of Service, Cyber Bricks will not refund any portion of your fees. If a user orders 2 services and uses only 1, Cyber Bricks shall have the right to charge the monthly price for both requested services.

We offer a 15-day money-back guarantee; hence if you cancel your subscription within this period, your request for refund shall be approved. All refunds from Cyber Bricks shall come with a deduction of 3% of the amount or the actual processing fee charged by the payment processor (whichever is higher). However, cancellation of the monthly or yearly plan after this period shall not result in a refund.

11. Billing, Termination, Cancellation, and Refund on Lifetime Subscriptions (Perpetual License)

Cyber Bricks offers a Lifetime Plan (Perpetual License), which will be perpetually active, provided that the Client has paid the one-time upfront fee. Lifetime plan holders are guaranteed 3 years (36 months) of access to Cyber Bricks. However, in the event that Cyber Bricks discontinues the service or ceases to do business for whatever reason, or in the event of an acquisition, change of control, significant merger, or other legal reorganization of Cyber Bricks, we may terminate the Perpetual License by returning your purchase price minus the amount computed by multiplying your purchase price by a fraction. Here, the numerator is the number of complete months after your purchase of the lifetime plan and the denominator is 36. 

If Cyber Bricks terminates your account because of a violation of our Terms of Use, Cyber Bricks shall not refund any portion of your license fees. Cyber Bricks may introduce additional services from time to time, which may be excluded from an existing lifetime plan without an additional payment. If your Cyber Bricks lifetime plan account remains inactive for a period of 1 year, we will consider that account to be dormant and will remove online access to the data. Then, we will keep the data for an additional 1 year, at which point we will delete your data. Activity is defined as a login to the Cyber Bricks account. 

You can cancel your lifetime plan at any time by contacting us. However, cancellation of a lifetime plan will not result in a refund.

12. Refund Policy

If Cyber Bricks and the Client agree that there is a refund to be issued, it will be processed within the following 30 days. However, the amount charged by the payment processor is non-refundable. Hence, all refunds from Cyber Bricks will come with a deduction of 3% of the amount or the actual processing fee charged by the Payment processor (whichever is higher).

Please note: If you upgrade to a higher plan, you will not be eligible for a refund, even if your 30-day period is not exhausted. We advise you to be 100% sure about your commitment to the platform before you go for an upgrade to a higher plan.

13. Free Trials, Cancellations, and Refunds on Subscription Renewals

All Cyber Bricks accounts begin with an obligation-free trial which will allow you to evaluate the service. Your credit card information will be collected to initiate a trial account. 

Please sign up for a monthly payment schedule if you are unsure of how long you will be using the service. Once you have subscribed to one of our paid plans, your subscription will renew automatically on your monthly or annual renewal date until you cancel. Your cancellation stops the future payments only and no refunds will be offered on renewal payments made to date. 

Renewal rates are subject to change, but we will always notify you beforehand. Cancellations can be made at any time by contacting [email protected]. We have a 15-day refund policy, and we will not be able to refund customers after the 15-day period.

14. Security

Controls for the Protection of Personal Data. Cyber Bricks shall maintain administrative, physical, and technical safeguards designed for protection of the security (including protection against unlawful or unauthorized processing and against accidental or unlawful destruction, loss or alteration or damage, unauthorized disclosure of, or access to, Customer data), confidentiality, and integrity of Customer data (including personal information).

Cyber Bricks has robust incident response management and data breach response policy in place. Also, we adhere to the procedures in case of any data breach and shall notify Customer without undue delay upon becoming aware of the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Customer data, including personal information, transmitted, stored or otherwise processed by Cyber Bricks or its sub-processors of which Cyber Bricks becomes aware (a “Customer Data Incident”) within 72 hours of confirmation of the incident via email and/or phone.

15. Return and deletion of customer data

Cyber Bricks shall return Customer data to the Customer and, to the extent allowed by the applicable law, delete Customer data in accordance with the procedures and timeframes specified in the Terms of Use.

If an account deletion request is raised from the Platform, the team will get in touch with you regarding the same within 7-10 days to seek confirmation and clarification on the request. Following the communication, the account will be deleted, and you will not be able to restore the data.

16. Disclaimer

To the maximum extent permitted by the applicable law, we exclude all representations, warranties, and conditions relating to our website and the use thereof. Nothing in this disclaimer shall:

• limit or exclude our or your liability for death or personal injury;

• limit or exclude our or your liability for fraud or fraudulent misrepresentation;

• limit any of our or your liabilities in any way that is not permitted under the applicable law; or

• exclude any of our or your liabilities that may not be excluded under the applicable law.

The limitations and prohibitions of the liability set in this section and elsewhere in this document: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the Terms of Use, including liabilities arising in contract or in tort.
